Any use of this website (hereinafter "Website") shall be subject to the following Site Terms and Conditions. 

1. General Information on the Website 

1.1 Robinson Club GmbH shall provide all general information on the Website purely as guidance for users. A user shall be anyone who uses the Website for booking or information purposes. General information shall be all information provided on the Website with the exception of information relating to travel services, travel prices, taxes and/or other mandatory legal information (such as that specified in clause 1.2 below). The general information shall be subject to change at any time. The user should therefore contact the relevant institutions, embassies or tourist information bureaus to check that the information provided is up to date. 

1.2 Information about entry requirements and health-related formalities shall only apply to users who are citizens of the Federal Republic of Germany, the Republic of Austria or Switzerland. For all other users, different rules may apply in this respect which they shall be required to find out about independently from the relevant consulate or a diplomatic representative. 

2. Use of the Website 

2.1 The Website is made available to users for personal use only. Travel, flight and other tourist services obtained through the Website (hereinafter jointly referred to as "Tourist Services") from our company and from various third-party companies, e.g. travel insurers, car hire companies, airlines etc. (hereinafter jointly referred to as "Providers") may not be resold or conveyed by users or be otherwise disclosed to third parties in return for a fee. 

2.2 Robinson Club GmbH hereby reserves the right to refuse access to this Website or parts thereof, for any user, at its sole discretion, and/or to cease operation of the Website without notice. 

2.3 The Website may only be used in the legally permissible manner and in accordance with these Site Terms and Conditions for the purposes provided for. Use in this sense shall mean, in particular, information about Tourist Services and, where applicable, booking thereof and any other legally compliant use of the features installed on the Website. By using the Website, the user hereby accepts and acknowledges the following in particular:
a) the user shall accept full responsibility for all negotiations undertaken in their name and using their personal data on the Website;
b) when using the Website to conclude agreements the user must be at least 18 years old and fully competent;
c) the user hereby states that all information he provides about himself and/or persons traveling with him shall be true and that he is authorized to declare such information;
d) the Website may not be used for speculative purposes, false or fraudulent bookings or block bookings;
e) threats, coercion, defamations and the transmission of pornographic, racist, inciting or otherwise unlawful and/or discriminatory material are expressly prohibited;
f) the Website and its content may not be changed, reproduced, sold, published or forwarded in any other way by the user. A single copy of the page may be made for personal, non-commercial use however;
g) files, software or other material protected by industrial property rights, copyright or privacy rights may not be circulated, except where such rights belong to the user or where the user has obtained the necessary consent;
h) files that contain viruses, corrupted files or software that could damage a third party's computer, may not be installed;
i) author assignments, legal notices and proprietary designations or marks contained in a loaded file (software or other material) may not be deleted or falsified;
j) no goods or services may be promoted or offered for sale by the user and surveys, competitions or chain letters may not be implemented or forwarded;
k) the Website may only be accessed via the relevant homepage. Use of the Website as part of the affiliate program shall require Robinson Club GmbH 's prior written consent. Links to the Website may not be shown in frames without Robinson Club GmbH 's prior written consent. 

2.4 The rules set out in clause 2.3 shall also apply to the bulletin boards, blogs, chat rooms and other communication forums (together "Forums") on the Website. All Forums are for public and not private communication. All third-party content in such Forums shall not be reviewed or approved by Robinson Club GmbH prior to placement. Robinson Club GmbH hereby reserves the right to remove any content communicated or submitted by users from the Forums without notice. 

2.5 The user hereby undertakes, through use of the Website, to hold Robinson Club GmbH and any companies affiliated with it pursuant to sections 15 and subsequent (hereinafter "Affiliated Companies"), partner companies and employees, free and harmless from any third-party claims (including the costs of an appropriate legal defense or legal proceedings) that relate to use of the Website and its content in breach of the contract, misuse thereof or otherwise unlawful use by the user, upon first request.  

3. Software 

3.1 Robinson Club GmbH, its Affiliated Companies and/or partner companies shall hold all intellectual property rights to the computer programs ("Software") written in programming language that Robinson Club GmbH may make available to download on the Website and/or otherwise operate in connection with the Website. The unauthorized use, duplication or dissemination of such Software is hereby expressly prohibited. 

3.2 The use of such Software may be subject to a special agreement ("License Agreement") and other terms and conditions. The user shall be informed in detail about the need for such an agreement beforehand. The user may not install, copy or use any Software that is subject to a License Agreement or that includes a License Agreement without first declaring their agreement to the terms and conditions of the License Agreement. 

3.3 Where the proprietor of the protected right does not require the conclusion of a License Agreement, it hereby grants the user a personal, non-transferable right of use, revocable at any time, which shall only cover private use of the Software for the purposes of accessing, viewing and contractually agreed use of the Website in compliance with these Site Terms and Conditions. 

3.4 Liability for material defects and legal defects for the Software shall only arise where compulsory due to legal requirements or expressly stipulated and, where applicable, only under the terms and conditions of the license agreement. 

3.5 Any copying of the Software on other servers and/or data media for the purposes of making further copies is hereby expressly prohibited. The same shall apply to backtracking through reverse engineering, decompiling and/or disassembling. 

4. Links to Other Internet Sites 

The Website may contain hyperlinks that lead to third-party Internet sites. Robinson Club GmbH has no influence over the structure and content thereof and therefore provides no warranty as to the accuracy, currentness, completeness and/or content of the information provided thereon. 

5. Changes to the Website 

Robinson Club GmbH hereby reserves the right to make changes to the Website and/or its content, particularly with regard to the selection of providers, features, information, databases and/or content thereof, at any time. 

6. Copyright and Brands 

6.1 Robinson Club GmbH and/or its affiliate companies or contracting partners shall own the copyright and all intellectual property rights over the Website and its content. Unless expressly stated otherwise, all content shall belong to Robinson Club GmbH and/or its Affiliated Companies or contracting partners only. The names TUI amello as well as all further TUI amello brands, logos and graphics and those of the TUI Group on the TUI amello Website are registered trademarks of Robinson Club GmbH or TUI AG and TUI Group. 

6.2 Robinson Club GmbH and/or its Affiliated Companies are hereby expressly authorized to use the brands shown on the Website. 

6.3 By using the Website the user shall not obtain any rights or licenses whatsoever to use the brands within the meaning of clauses 6.1 and 6.2.
